Felonies and misdemeanors under North Carolina law

North Carolina crimes are classified as misdemeanors or felonies, based on the severity of the offense. Among misdemeanors, there are the following four classes:

  • Class 1 and A1 — Convictions for the most serious misdemeanor offenses, such as prostitution or assault inflicting injury, are punishable by a jail term of up to 150 days and/or community service
  • Class 2 — A conviction for an intermediate offense, such as assault and battery or carrying a handgun without a permit, can carry a sentence lasting from one to 60 days of jail and/or community service.
  • Class 3 — A conviction for the least serious misdemeanor offenses, such as shoplifting, can result in one to 20 days of days of jail and/or community service.

North Carolina divides felony crimes into 10 classes, from the least severe (Class I) to the most severe (Class A). A sentence for a Class I felony can run from three to 12 months, while a Class A felony conviction can mean the death penalty or life in prison without parole.

Defense against violent crime allegations in the New Bern area

Though the violent crime rate is lower in New Bern than in the whole of North Carolina, our criminal defense attorneys have extensive experience defending clients charged with:

  • Armed robbery — Defined as theft by force or fear, robbery is a Class G felony. But the offense is much more serious when a weapon, such as a knife or firearm, is involved. Armed robbery in North Carolina is a Class D felony.
  • Assault and battery — North Carolina does not have separate, discrete charges for assault and battery like some other states. An assault and battery count is brought when someone is alleged to have caused injury to another person. Simple assault is a misdemeanor that occurs when someone attempts to harm someone physically or makes a display of force that threatens imminent assault and battery. These are generally Class 2 misdemeanors. Felonious assault occurs when an assailant uses a deadly weapon and/or causes great bodily injury to another person.
  • Traffic offenses — Our attorneys provide traffic defense for motorists accused of a wide range of moving violations, such as speeding, reckless driving, and DWI/DUI.

Whatever the charges against you, our attorneys are prepared to fight with all our resources to help you pursue the best possible outcome.
